Help! My Child Was Taken to Juvenile Detention. What Do I Do?

by | Oct 3, 2023 | Firm News, Juvenile |

As a mother, I know that being a parent can be just as difficult as it is rewarding somedays.  One of the last things a parents wants is that phone call that your child has been arrested.

It’s natural to feel overwhelmed and anxious when your child is in juvenile detention. You can contact the juvenile detention center in Franklin to inquire about your child’s well-being and to get information on visitation procedures. They can provide you with essential details about your child’s stay and any upcoming court hearings.

When your child is involved in Williamson County Juvenile Court, a Youth Service Officer (YSO) will be assigned to their case. They are there to help facilitate communication between you, your child, and the court.

Pursuant to Tennessee Code Annotated (T.C.A.) § 37-1-114, if your child is in juvenile detention, a detention hearing must take place within 72 hours of your child’s detention.  At this hearing, the judge or magistrate will determine whether your child will remain in custody or not. The judge will decide whether your child should remain in detention, be released to your custody, or be placed in an alternative program or facility.  This detention hearing is a pivotal moment in your child’s case, and it’s crucial to have legal representation to advocate for their best interests.

Sometimes at a detention hearing in Williamson County, the judge will release your child to your custody while a case is pending its final outcome.  This often times means the child could be placed on “in-home detention.”  Although this sounds similar to “house arrest,” while on in-home detention, a child is still allowed to attend school and sometimes extra curricular activities.

One of the most important steps you can take as a parent in this situation is to seek legal counsel. An experienced juvenile defense attorney like Nichole Dusche can provide guidance, represent your child’s interests in court, and work to secure their release or placement in an appropriate program. She can also help you understand the legal process and your child’s rights.

You’re not alone in this journey, and with the right support, you can work toward the best possible outcome for your child’s future.  Contact Attorney Nichole Dusche in Franklin today: 615-861-1298.
