Understanding the Updated TN Law on Threats of Mass Violence on School Property

As of July 1, 2024, important changes to Tennessee Code Annotated TCA 39-16-517 regarding threats of mass violence on school property have taken effect. 1. Reclassification of the Offense: Originally enacted in 2021 as a Class A misdemeanor, the law has now been elevated to a Class E felony.

2. License Suspension for Juveniles: Another critical addition to the law is the penalty for juveniles adjudicated delinquent of this offense. Any child found guilty will face a suspension of his or her driver’s license for one year. For those who do not yet have a license, there will be a delay of one year before they can obtain it.

3. Zero Tolerance Policy: This law has always been considered a zero-tolerance offense within the school system in Williamson County. In Williamson County, any child accused of this crime will be immediately transported to the juvenile detention facility and held until a detention hearing can be set.

4. Detention Hearings: Both Williamson and Maury County require detention hearings for juveniles accused of this offense. During these hearings, a judge will determine whether the child should be released to their parents or held in detention until the final resolution of the case. Often if a child is sent home to the custody of their parents, the court will order additional restrictions while the case is pending, including safety monitoring and a sweep of the child’s bedroom.

5. Additional Consequences in Williamson County: In Williamson County, further measures may be imposed, such as a pat-down order. This requires the student to be searched prior to entering school property.
